General Terms and Conditions
Effective from 15 October 2026; in the new webshop with the changes listed at the end of the page (last amended: 21 October 2026)
Note: This is a translation. The Hungarian version is legally binding.
1. Introduction and Service Provider details
These General Terms and Conditions (hereinafter: T&C) of AVEROLS-MANDO Kft. (registered office: 1055 Budapest, Nyugati tĂ©r 7.; company registration number: 01-09-375298; court of registration: FĹ‘városi TörvĂ©nyszĂ©k CĂ©gbĂrĂłsága (Court of Registration of the Budapest-Capital Regional Court); tax number: 28819763-2-41; e-mail: info@griffwebshop.com; telephone: +36 70 320 00 52; hereinafter: Service Provider) govern the conditions of use of the griffwebshop.com webshop operated by it (hereinafter: Webshop or GRIFFWEBSHOP), as well as the rights and obligations of the Service Provider and the Client (hereinafter: Customer or Client).
These T&C apply to all electronic commerce services provided through the Webshop, regardless of the country from which the Customer purchases and the language version used. The Webshop is available in Hungarian, German, Polish, Slovak, Czech and English; the language of the contract is Hungarian. The T&C in languages other than Hungarian are an informative translation; in the event of any discrepancy, the Hungarian version prevails. Purchases in the Webshop are governed by the following legislation:
- Act V of 2013 on the Civil Code (Ptk.);
- Act CVIII of 2001 on electronic commerce services (Ektv.);
- Act CLV of 1997 on consumer protection (Fgytv.);
- Government Decree No. 45/2014 (II.26.) on consumer contracts;
- Government Decree No. 373/2021 (VI.30.) on warranty;
- Government Decree No. 151/2003 (IX.22.) on the guarantee applicable to durable consumer goods.
The Service Provider is not subject to any code of conduct within the meaning of Act XLVII of 2008 on the prohibition of unfair commercial practices against consumers. The T&C are continuously available on the Webshop's page griffwebshop.com/aszf, can be saved and printed from the browser, and can be downloaded in PDF format: griffwebshop.com/static/aszf.pdf.
2. Account, Griff Club discount and newsletter
Account:
- There is no registration or password in the Webshop. For an order placed at checkout, the Customer confirms their e-mail address with a 6-digit, single-use code sent by the Webshop by e-mail (login); for express checkout (Apple Pay, Google Pay), the e-mail address is provided by the Customer's digital wallet. The login remains valid on the same device for 30 days. Upon first login, the Webshop opens an account for the Customer (My orders, Favourites, My invoices, My cards, My details), which the Customer may delete at any time under Account › My details. The Customer is obliged to provide all requested data accurately and completely. The Service Provider is not liable for any delay or damage arising solely from the Customer having provided incorrect or inaccurate data.
- Logging in and opening an account, as well as viewing and using the Webshop, browsing in the Webshop and placing products in the cart, do not in themselves constitute acceptance of the T&C. The Customer expressly accepts the T&C before submitting the order by ticking a separate checkbox (section 3).
- The details of the processing of the personal data provided during login and ordering are set out in the Privacy Notice (section 12). The legal basis for processing the data necessary for fulfilling the order is the performance of the contract (Article 6(1)(b) of the General Data Protection Regulation, i.e. Regulation (EU) 2016/679); the Customer's consent is not required for this. Neither reading the Privacy Notice nor ticking the checkbox for accepting the T&C constitutes consent to data processing.
- The Service Provider sends newsletters and other messages containing advertising only on the basis of the Customer's separate, voluntary consent. The Customer may give consent by subscribing in the "Levél az új darabokról" ("Letter about the new pieces") field in the footer of the Webshop. Consent is not a condition of logging in or of purchasing, and the Customer may withdraw it at any time, for example by a message sent to info@griffwebshop.com.
Griff Club discount:
- Every Customer who has an account in the Webshop (that is, who has confirmed their e-mail address with the login code) is a member of the Griff Club free of charge. Club members receive a 10% discount on the price of full-price products; the club discount does not apply to sale (reduced-price) products. The club price is shown on the product page and at checkout; checkout deducts the discount automatically and shows the discounted price before the order is submitted. Club membership ends when the account is deleted.
3. Order and conclusion of the contract
- Ordering process: The Customer places the product in the cart, provides or verifies their delivery and billing details at checkout, selects the delivery and payment methods, ticks the checkbox for accepting the T&C, and then clicks the button that finalises the order and is labelled to indicate an obligation to pay. In this webshop, payment by Apple Pay or Google Pay is also made at checkout, after ticking the same checkbox; express checkout outside the checkout is not available. Placing the order entails an obligation to pay.
- Acceptance of the T&C: The T&C can be viewed, downloaded and saved at any time before the order is submitted (section 1). Before submitting the order, the Customer expressly accepts the T&C at checkout by ticking the separate checkbox provided for that purpose; without ticking the checkbox, the order cannot be submitted and an Apple Pay or Google Pay payment cannot be started. By this acceptance, the T&C become part of the contract.
- Conclusion of the contract: The Service Provider confirms receipt of the order without delay by e-mail. If this confirmation does not reach the Customer within the reasonable time limit, depending on the nature of the service, counted from the submission of the order, but no later than 48 hours, the Customer is released from the binding effect of the offer or from the contractual obligation (Section 6(2) of the Ektv.). The order constitutes an offer; the contract is concluded when the e-mail confirming the order reaches the Customer. For payment by bank card and by wallet (Apple Pay, Google Pay), the Service Provider sends this e-mail after successful payment; if the payment is unsuccessful, no contract is concluded, and the Service Provider closes the unpaid order after 48 hours at the latest.
- Correction of data entry errors: Before submitting the order, the Customer may check and correct at checkout the contents of the cart (the products and the quantity), their delivery and billing details, and the delivery and payment methods. The Customer may request modification of the data of an order already submitted from customer service (info@griffwebshop.com).
- Prices: Prices are gross amounts in the currency belonging to the delivery country (EUR, GBP, USD, CHF, PLN, CZK, RON, SEK, DKK, NOK, CAD or AUD); for delivery addresses within the European Union they include VAT, and for delivery addresses outside the European Union section 4 (Customs and import taxes) applies. The Webshop converts prices from the forint price at an exchange rate fixed weekly; checkout shows the amount payable in the Customer's currency before the order is submitted, and the Customer pays the amount shown when ordering. The right to change prices is reserved, but for confirmed orders the price recorded in the confirmation applies.
- Obvious pricing error: If a product appears in the Webshop at an obviously incorrect price (e.g. €0, €1):
- Before the conclusion of the contract (until the Service Provider has confirmed the order by e-mail), the Service Provider is not obliged to accept and confirm the order at the incorrect price. If the Service Provider therefore does not accept the order, it informs the Customer without delay by e-mail and, if the Customer has already paid, refunds the entire amount paid without delay. No contract is concluded in such a case.
- After the conclusion of the contract (following the confirmation of the order by e-mail), the Service Provider informs the Customer of the error without delay by e-mail and offers the Customer the option to confirm the order at the correct price or to withdraw from the contract. If the Customer confirms the order at the correct price, the Service Provider performs the contract at the correct price. If the Customer withdraws from the contract, the Service Provider refunds without delay the entire amount already paid by the Customer.
4. Delivery
- Delivery area: The Webshop delivers by courier to Hungary and to the countries selectable at checkout; through this English-language shop to the member states of the European Union and to the non-EU countries selectable at checkout. The current list of countries is shown at checkout. There is no in-store pickup and no delivery to parcel lockers.
- Carrier: Products are delivered by a courier service engaged by the Service Provider. The Customer receives the tracking link by e-mail after dispatch.
- Delivery time: The Service Provider usually hands products in stock over to the courier within 1 working day of the conclusion of the contract, and new-collection products usually within 2–3 working days. Delivery then usually takes a further 2–5 working days, depending on the country. If the Service Provider performs late or fails to perform, the Service Provider is liable under the rules of the Civil Code, even if the delay or non-performance was caused by the carrier it engaged. In such a case, the Customer may demand performance, may withdraw from the contract under the conditions laid down in the Civil Code, and may claim compensation for damage resulting from the delay or non-performance, unless the Service Provider is exculpated for its breach of contract under the Civil Code. This does not affect the right of withdrawal under section 7.
- Delivery: We notify the Customer of dispatch and delivery by e-mail. If delivery is unsuccessful, the rules of the courier service in the destination country apply; the Customer may arrange a new time or address via the tracking link received by e-mail or at info@griffwebshop.com.
- Eco-friendly delivery: The Webshop does not currently offer a separate eco-friendly delivery method.
- Receipt of the parcel: We ask the Customer to check the integrity of the packaging upon receipt of the parcel and, if the parcel is visibly damaged, where possible to ask the courier to record the damage in a report, as this facilitates settlement of the damage. Drawing up a report is not a condition of the Customer's claims: its absence does not preclude the Customer from asserting a claim for damaged, incomplete or defective performance. If the Customer notices the damage, shortage or defect only after the courier has left, it may report it afterwards as well, at info@griffwebshop.com or at the contact details given in section 10. A defect notified within two months of its discovery is deemed to have been notified without delay (section 8). In the case of an incomplete parcel, the Service Provider supplies the missing product; this does not affect the Customer's other rights based on legislation. In the case of a damaged or defective product, the Customer is entitled to the warranty rights described in section 8 and in Annex 2.
- Delivery fee:
- For delivery addresses outside Hungary, the delivery fee is a uniform amount per order, charged in the Customer's currency: €9.99, £8.99, US$10.99, CHF 8.99, 42.99 zł, 239 Kč, 51.99 lei, SEK 109, DKK 79, NOK 109, CA$15.99 or A$15.99. These amounts are converted from HUF 3,500 at the exchange rate fixed weekly and may therefore change slightly.
- There is no free-delivery threshold for delivery abroad.
- The exact amount is shown at checkout before the order is submitted.
- Several separately placed orders may incur separate delivery fees, unless the Customer asks customer service to handle them together.
- Customs and import taxes (outside the EU): Products sent to a delivery address outside the European Union qualify as exports: the Service Provider issues the invoice without Hungarian VAT (Section 98 of Act CXXVII of 2007 on value added tax). Any customs duty, import VAT and customs clearance fee arising in the destination country are paid by the Customer, usually upon receipt of the parcel. The Service Provider does not know these amounts and does not include them in the purchase price.
5. Payment methods
- Available method:
- Online payment: by bank card, Apple Pay or Google Pay, through the secure payment page of Revolut Bank UAB (SSL and 3D-Secure technology). The Service Provider neither sees nor stores card data. At checkout, the Customer may request, by a separate checkbox, that Revolut save their card for the next order; the saved card may be deleted at any time under Account › My cards.
- Delivery abroad: For delivery addresses outside Hungary, only online payment (bank card, Apple Pay or Google Pay) is available; cash on delivery and the redemption of Griff Forint are not. The Customer pays in the currency belonging to the delivery country (EUR, GBP, USD, CHF, PLN, CZK, RON, SEK, DKK, NOK, CAD or AUD).
- Invoice: The Service Provider issues an electronic invoice for the purchase and reports it to the NAV Online Invoicing system (Online Számla; NAV is the Hungarian National Tax and Customs Administration). The invoice is generated after successful payment. The Customer receives the invoice download link by e-mail and may also download it under Account › My invoices. By placing the order, the Customer accepts that the invoice is received in electronic form (Section 175 of Act CXXVII of 2007 on value added tax); a paper invoice may be requested at info@griffwebshop.com. For an invoice issued in a company's name, the company name and tax number must be provided at checkout; the data of an issued invoice can subsequently be modified only by cancelling the invoice and issuing a new one. For purchases from abroad, the invoice is issued in the currency in which the Customer pays; the data also to be shown in forints are converted by the Service Provider at the exchange rate of the Magyar Nemzeti Bank (MNB, the central bank of Hungary) valid on the date of performance. For delivery addresses outside the European Union, the invoice is issued without Hungarian VAT (section 4).
6. Product reservation
- Product reservation is not available in the Webshop.
7. Right of withdrawal (for consumers only)
- Definition of consumer: A natural person acting for purposes outside the scope of their economic activity (Section 8:1, point 3 of the Civil Code).
- Legal basis: Under Government Decree No. 45/2014 (II.26.), the consumer may withdraw from the contract within 14 days without giving any reason.
- Time limit: The withdrawal period expires after 14 days from the day on which the Customer, or a third party designated by the Customer other than the carrier, takes possession of the product. If the Customer buys several products in one order and receives them at different times, the time limit runs from the receipt of the last product received; in the case of a product consisting of several items or pieces, from the receipt of the last item or piece. The Customer may exercise the right of withdrawal in the period between the day of conclusion of the contract and the day of receipt of the product, that is, also before receiving the product; in that case the Customer is not obliged to accept the parcel. Before the order is confirmed (the contract is concluded), the Customer may also cancel the order.
- Withdrawal statement: The Customer may exercise the right of withdrawal by completing and sending the model withdrawal form in Annex 1 at the end of the T&C, or by another statement clearly expressing the intention to withdraw. The statement may be delivered to the Service Provider, for example, by e-mail (info@griffwebshop.com) or by post (1055 Budapest, Nyugati tér 7., AVEROLS-MANDO Kft.). The model form is also available for separate download: griffwebshop.com/static/elallasi-nyilatkozat.pdf. Use of the model form is not mandatory. The right of withdrawal is deemed to have been exercised in time if the Customer sends the statement before the expiry of the time limit. The burden of proving that the Customer exercised the right of withdrawal in accordance with this section lies with the Customer.
- Withdrawal in the Webshop: The Customer may also exercise the right of withdrawal by means of the Webshop's Elállás a szerzĹ‘dĂ©stĹ‘l (Withdrawal from the contract) function (griffwebshop.com/elallas), without logging in: the Customer enters their name, the order number and their e-mail address, and sends the statement with the "Elállás megerĹ‘sĂtĂ©se" ("Confirm withdrawal") button. The Service Provider sends, without undue delay, an acknowledgement of receipt of the withdrawal by e-mail, which contains the content of the withdrawal and the date and time of submission.
- Return: The Customer is obliged to send back or hand over the product to the Service Provider without delay, but no later than within 14 days from communicating the withdrawal (address: 1055 Budapest, Nyugati tér 7., AVEROLS-MANDO Kft.). The time limit is deemed to have been met if the Customer sends the product before the expiry of the time limit. The direct cost of returning the product is borne by the Customer, including when returning it from abroad.
- Refund: If the Customer withdraws from the contract, the Service Provider refunds without delay, but no later than within 14 days from learning of the withdrawal, the entire amount paid by the Customer as consideration, including the costs incurred in connection with performance, and thus the delivery fee as well. If the Customer has expressly chosen a delivery method other than the least expensive standard delivery method, the Service Provider does not refund the additional costs arising from this. The Service Provider makes the refund by the same payment method used by the Customer; with the Customer's express consent, it may use another payment method, but the Customer bears no additional fee as a result. The refund is made in the currency in which the Customer paid.
- Withholding: The Service Provider may withhold the refund until it has received the product back or the Customer has proved beyond doubt that it has been sent back, whichever is earlier. The Service Provider may not withhold the refund if it has undertaken to collect the product itself.
- Diminished value: The Customer may use the product to the extent necessary to establish its nature, characteristics and functioning (e.g. by trying it on). The Customer is liable only for the diminished value resulting from use beyond this; such use does not exclude the right of withdrawal.
- Further costs: In connection with the exercise of the right of withdrawal, the Customer bears no costs other than those stated in this section.
- Exceptions: Under Section 29 of Government Decree No. 45/2014 (II.26.), the Customer may not exercise the right of withdrawal, in particular,
- in the case of a product in sealed packaging which, for health protection or hygiene reasons, cannot be returned after being opened following delivery (e.g. underwear in sealed packaging), if the packaging was opened after delivery;
- in the case of a product that is perishable or retains its quality only for a short time;
- in the case of a non-prefabricated product that was made on the basis of the Customer's instructions or at the Customer's express request, or that is clearly personalised for the Customer.
8. Warranty and guarantee
Detailed information on the seller's warranty for defects (kellékszavatosság) and the producer's liability for defective products (termékszavatosság) is contained in Annex 2 at the end of the T&C, which is the model information under Annex 3 to Government Decree No. 45/2014 (II.26.). Sections 8.1 and 8.2 below are a short summary of it.
The harmonised notice on rights under the seller's statutory guarantee, in accordance with Annex I to Commission Implementing Regulation (EU) 2025/1960 (Section 11(1a)(a) of Government Decree No. 45/2014 (II.26.)):

8.1. Warranty for defects (kellékszavatosság)
- When can it be asserted? In the event of defective performance by the Service Provider, the Customer may assert a warranty claim against the Service Provider under the rules of the Civil Code and Government Decree No. 373/2021 (VI.30.).
- Rights: At the Customer's choice, the Customer may request repair or replacement, unless fulfilling the chosen claim is impossible or would cause the Service Provider disproportionate additional costs compared with fulfilling the other claim. If the Customer did not request, or could not request, repair or replacement, or if the Service Provider did not carry out, refused or did not undertake the repair or replacement, if a repeated defect has arisen, or if the defect is so serious that an immediate price reduction or immediate termination of the contract is justified, the Customer may request a proportionate reduction of the purchase price or, as a last resort, withdraw from the contract (terminate the contract). Withdrawal is not available for a minor defect; it is for the Service Provider to prove that the defect is minor. The Customer may switch from the chosen right to another one; the cost of switching is borne by the Customer, unless the switch was justified or the Service Provider gave cause for it. The Customer may neither repair the defect itself at the Service Provider's expense nor have it repaired by another person.
- Time limit: The Customer is obliged to notify the defect without delay after discovering it; a defect notified within two months of its discovery is deemed to have been notified without delay. After the two-year limitation period from performance, the warranty right can no longer be asserted. If the Service Provider remedies the defect by repair, the limitation period of the warranty claim is extended once by twelve months.
- Conditions: Within one year of performance, the assertion of a warranty claim has no condition other than notification of the defect, provided that the Customer proves that the product was sold by the Service Provider. A defect discovered within one year is presumed to have existed already at the time of performance, unless this presumption is incompatible with the nature of the product or the nature of the defect. After one year, the Customer must prove that the defect already existed at the time of performance.
- Notification: The defect can be reported at the contact details given in section 10. It is not a condition of asserting the claim that the Customer had a report drawn up when receiving the parcel (section 4).
8.2. Producer's liability for defective products (termékszavatosság)
- When can it be asserted? In the event of a defect of the product, the Customer may, at its choice, assert its warranty right (section 8.1) or a product liability claim. The product is defective if it does not meet the quality requirements in force at the time it was placed on the market, or does not have the characteristics stated in the description given by the manufacturer.
- Rights: Only repair or replacement of the defective product can be requested.
- Against whom? Against the producer or distributor of the product (hereinafter together: manufacturer).
- Time limit: Within two years of the product being placed on the market by the manufacturer; upon expiry of this time limit, the right is lost. The defect must be notified to the manufacturer without delay after its discovery; a defect notified within two months of its discovery is deemed to have been notified without delay.
- Conditions: The Customer must prove that the defect existed at the time the product was placed on the market by the manufacturer. The manufacturer is exempt if it proves that it did not manufacture or place the product on the market in the course of its business activity, or that the defect was not discoverable at the time of placing on the market in the light of the state of scientific and technical knowledge, or that the defect of the product results from the application of a legal provision or a mandatory official requirement.
- Parallel claims: A warranty claim and a product liability claim for the same defect may be asserted simultaneously, in parallel with each other. In the case of a successful product liability claim, a warranty claim concerning the replaced product, or the repaired part of the product, can thereafter be asserted only against the manufacturer.
8.3. Guarantee
- The Webshop does not sell products subject to the mandatory guarantee under Government Decree No. 151/2003 (IX.22.), so there is no guarantee obligation, unless legislation expressly requires it.
9. Special provisions for businesses (B2B)
- Definition of business: A person acting within the scope of their profession, independent occupation or business activity (Section 8:1, point 4 of the Civil Code).
- Conclusion of the contract: The sales contract is concluded by confirmation of the order. The Customer is responsible for erroneous orders.
- Delivery and risk of loss: The risk of loss passes to the Customer upon handover to the carrier.
- Payment: By the deadline stated on the invoice; in case of delay, default interest under the Civil Code is payable.
- Discounts:
- Above net HUF 200,000: 6% additional discount.
- Above net HUF 300,000: 10% additional discount.
- Warranty: The Customer is obliged to notify the defect in writing within 5 days and to make the product available for inspection. The Customer bears the burden of proving the defect.
- Right of withdrawal: Does not apply to businesses.
- Free delivery: Not provided; the Service Provider notifies the delivery costs in advance.
- Placing orders: Absent a different agreement, on Fridays.
10. Complaint handling and legal disputes
- Submitting a complaint: E-mail: info@griffwebshop.com; postal address: 1055 Budapest, Nyugati tér 7., AVEROLS-MANDO Kft.; telephone: +36 70 320 00 52. The Service Provider responds within 5 working days and, in the case of a warranty claim, draws up a report (NGM Decree No. 19/2014 (IV.29.); NGM is the Hungarian Ministry for National Economy).
- Consumer protection authority and legal disputes: For a consumer protection complaint, the Customer may turn to the government office (kormányhivatal) competent according to their place of residence or stay, as the consumer protection authority. For the out-of-court settlement of a consumer dispute, the Customer may turn to the competent conciliation body or court as set out below.
- Conciliation body: A Customer qualifying as a consumer may, in the event of a consumer dispute, turn to the conciliation body (békéltető testület) competent according to their place of residence, place of stay or registered office. Competence is determined by Section 20 of Act CLV of 1997 on consumer protection (Fgytv.):
- the conciliation body competent for the proceedings is the one at the place of residence or stay of a consumer who is a natural person, or at the registered office of a consumer who is not a natural person (Section 20(1) of the Fgytv.);
- if the consumer has no domestic place of residence, place of stay or registered office, the competence of the conciliation body is established by the Service Provider's registered office; on the basis of the Service Provider's registered office (1055 Budapest), this is the Budapest Conciliation Body (Budapesti Békéltető Testület) (Section 20(2) of the Fgytv.);
- at the consumer's request to that effect, the conciliation body indicated in the consumer's request is competent instead of the body that is competent under the foregoing (Section 20(3) of the Fgytv.).
- Contact details of the conciliation bodies: Eight conciliation bodies operate in Hungary. The name, territorial competence, registered office, postal address, telephone number, e-mail address and website of each body are set out in Annex 3 at the end of the T&C; the annex also shows which body is competent for a consumer residing in which county or in Budapest. Information about the bodies is also available at bekeltetes.hu.
11. Copyright and liability
- The content of the Webshop (product descriptions, images, graphics) is protected by copyright; its use without permission is prohibited.
- The Service Provider is not liable for damage that can be attributed solely to the Customer's own conduct or to erroneous data provided by the Customer. The Service Provider is liable for its breach of contract, including late, defective or failed performance and technical errors, under the rules of the Civil Code, including for the conduct of the contributors it engages (for example the carrier and the payment service provider); these T&C neither exclude nor limit this liability.
12. Data protection
The details of data processing can be found in the Webshop's Privacy Notice, available at griffwebshop.com/adatkezeles. Reading the Privacy Notice does not constitute consent to data processing; the legal basis of data processing is covered by section 2 and the Privacy Notice.
13. Miscellaneous provisions
- The Service Provider reserves the right to amend the T&C unilaterally; the amendment takes effect upon publication and applies to new orders.
- The invalidity of individual provisions of the T&C does not affect the validity of the other provisions.
- The language of the contract is Hungarian. The concluded contract qualifies as a written contract; the Service Provider files it in electronic form and it is accessible afterwards.
- Orders can be placed only in the Webshop; there are no orders by telephone or post.
14. Short checkout warnings
- Delivery abroad: a uniform fee per order in the Customer's currency (for example €9.99, £8.99 or US$10.99), with no free-delivery threshold (section 4).
- Payment: for delivery abroad, online only (bank card, Apple Pay, Google Pay); cash on delivery is not available (section 5).
- Outside the EU: any customs duty and import taxes in the destination country are paid by the Customer (section 4).
- B2B orders: Return/withdrawal is not possible; the discounted prices do not include a guarantee.

Model information on warranty for defects, producer's liability for defective products and guarantee
1. Warranty for defects (kellékszavatosság)
In what cases can you exercise your warranty right?
In the event of defective performance by AVEROLS-MANDO Kft., you may assert a warranty claim against the business under the rules of the Civil Code.
What rights do you have under your warranty claim?
At your choice, you may assert the following warranty claims:
You may request repair or replacement, unless fulfilling the claim chosen by you is impossible or would involve disproportionate additional costs for the business compared with fulfilling your other claim. If you did not request, or could not request, repair or replacement, you may claim a proportionate reduction of the consideration, or you may repair the defect at the business's expense yourself or have it repaired by another person, or, as a last resort, you may also withdraw from the contract. In the case of a contract between a consumer and a business for the sale of goods that qualify as movable property, for the supply of digital content or for the provision of digital services, in exercising your warranty rights you may neither repair the defect yourself at the business's expense nor have it repaired by another person.
You may switch from your chosen warranty right to another one; however, you bear the cost of switching, unless it was justified or the business gave cause for it.
Within what time limit can you assert your warranty claim?
You are obliged to notify the defect without delay after discovering it, but no later than within two months of discovering the defect. However, we draw your attention to the fact that after the two-year limitation period from the performance of the contract, you can no longer assert your warranty rights. In the case of a used item, this time limit is two years, but at least one year.
Against whom can you assert your warranty claim?
You may assert your warranty claim against the business.
What other conditions apply to asserting your warranty rights?
Within one year of performance, the assertion of your warranty claim has no condition other than notification of the defect, provided that you prove that the product or service was supplied by the business AVEROLS-MANDO Kft. After one year from performance, however, you are obliged to prove that the defect you have identified already existed at the time of performance.
2. Producer's liability for defective products (termékszavatosság)
In what cases can you exercise your product liability right?
In the event of a defect of a movable item (in this section, hereinafter: product), you may, at your choice, assert the right defined in section 1 or a product liability claim under the rules of the Civil Code.
What rights do you have under your product liability claim?
As a product liability claim, you may request repair or replacement of the defective product.
Against whom can you assert your product liability claim?
You may exercise your product liability rights against the producer or distributor of the product (hereinafter together: manufacturer).
In what case is the product considered defective?
The product is defective if it does not meet the quality requirements in force at the time it was placed on the market, or if it does not have the characteristics stated in the description given by the manufacturer.
Within what time limit can you assert your product liability claim?
You may assert your product liability claim within two years of the product being placed on the market by the manufacturer. Upon expiry of this time limit, you lose this entitlement.
What rule on proof applies when asserting a product liability claim?
When asserting a product liability claim, you must prove that the product defect existed at the time the product was placed on the market by the manufacturer.
In what case is the manufacturer exempt from its product liability obligation?
The manufacturer is exempt from its product liability obligation if it can prove that
- it did not manufacture or place the product on the market in the course of its business activity, or
- the defect was not discoverable at the time of placing on the market in the light of the state of scientific and technical knowledge, or
- the defect of the product results from the application of a legal provision or a mandatory official requirement.
It is sufficient for the manufacturer to prove one ground for the exemption.
We draw your attention to the fact that, for the same defect, you may assert a warranty claim against the business and a product liability claim against the manufacturer simultaneously, in parallel with each other. If you successfully assert your product liability claim, you may thereafter assert your warranty claim concerning the replaced product, or the part of the product affected by repair, only against the manufacturer.
Note: under the legislation, section 3 (Guarantee) of the model information has to be included in the information only if the business is obliged to give a guarantee. Under section 8.3, the Service Provider is not obliged to give a guarantee, so this section is not included.
